Selection of Chairperson – Option One (require District resident); 2. Testimony for ZC and BZA Cases – Option Two (allow third category “undeclared”); 3. ZC Authority – Option One (clarify that ZC can determine to hear any case BZA can hear); 4. ANC Input at Setdown – Option One (allow an ANC Setdown Form in contested cases other than stand-alone map amendments); 5. Maintenance of Posting – Option One (require Affidavit of Maintenance of Posting between two and six calendar days prior to hearing); 6. Ethics Requirements – Option One (add language regarding existing ethical requirements from other codes); 7. Right to Stay a Final Decision – Option One (clarify ability of ZC and BZA to stay a final decision, pending appeal); 8 Organization of Chapters on Nonconformities – Option One (reorganize Chapter 20 to separate use and structure regulations); 9. Additions to Nonconforming Structures – Option One (delete § 2001.3(a), which disallows matter-of-right enlargements to an existing building with nonconforming lot occupancy); 10. Changing Nonconforming Uses – Option One (require any change to one non-conforming use to another to first obtain approval of the BZA; utilize evaluative criteria similar to those current I § 200); 11. “Non-expandable Conforming” Uses – Option One (allow for the continuation of “non-expandable” uses such as hotels in R-5); 12. Alley Lots – Option One (clarify that a record lot is required to obtain a building permit for a new building on an alley lot and modify § 403.6 to require minimum frontage standards on alleys); 13. Modifications to a Dwelling in a Theoretical Subdivision – Option One (when modifying an approved § 2516 application, an individual homeowner may apply for an expedited review); 14. Institutional and Educational Uses under § 2516 – Option One with amended language, taken from Nancy MacWood, that an “…institution can include a request for a waiver from § 2516 as part of its special exception application”; 15. FAR Calculations – Option One (clarify that the land area of private rights-of-way may not be used in FAR calculations); 16. Standards for Private Drives – OP asked to postpone this recommendation, as they are still conferring with DDOT; 17. Zoning Administrator Flexibility – Option One (consolidate flexibility standards, establish consistency across different types of orders, and determine criteria for evaluating flexibility); 18. Expiration of Setdown – Option One (institute a two-year sunset clause for setdowns); and 19. Building Permits – Option One (describe which building permits vest the zoning regulations for a property).
