17521 Application of 601-645 H Street Ventures LLC At the February 6, 2007 public meeting, the Board GRANTED a special exception from subsection 1303.2 to permit a relocated curb cut on H Street to allow the construction of a new mixed-use (residential and commercial) building on a lot that has six-thousand square feet or more of land under subsections 1320.4 and 1325 in the H Street Northeast Neighborhood Commercial Overlay District. Previously, on December 5, 2006, at the Applicant’s request, the Board bifurcated its decision and GRANTED relief from the following four zoning requirements: (1) the lot occupancy requirements under section 772, (2) variance from the residential recreation space requirements under section 773, (3) special exception from the lot occupancy requirements under subsection 1324.4, and (4) special exception from §2514.2 for a 35-foot extension of a lesser restrictive district into a more restrictive district.

There were some concerns (mainly with height) that the ZC would like the applicant to address before the case moves forward. The applicant's representative (Phil Feola) asked if the ZC would consider taking action on the case as a 1st stage PUD since the concerns the ZC has will take some time to address. Chairman Mitten replied that the ZC would consider that proposal, but was not prepared to move forward at this time.
